DMCA Copyright Policy for Becky Quick

Becky Quick respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Becky Quick will respond expeditiously to claims of copyright infringement committed using the Becky Quick service that are reported to Becky Quick's Designated Copyright Agent, identified in the sample notice below.

Filing a Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Becky Quick website by completing the following DMCA Notice of Alleged Infringement and delivering it to Becky Quick's Designated Copyright Agent.

Upon receipt of the Notice as described below, Becky Quick will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Becky Quick website.

  1. **Identify the copyrighted work** that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. **Identify the material** that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Becky Quick to locate the material, including at a minimum, if applicable, the URL of the link shown on the Becky Quick website where such material may be found.
  3. **Provide your mailing address, telephone number, and, if available, email address.**
  4. **Include both of the following statements** in the body of the Notice:
    • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. **Provide your full legal name and your electronic or physical signature.**

Counter-Notification Procedures

If you believe that material you posted on the Becky Quick website was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notification with Becky Quick by submitting a written notification to our Designated Copyright Agent identified above. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Becky Quick may be found, and that you will accept service of process from the person who provided the initial DMCA notification or an agent of such person.

Upon receipt of a Counter-Notification, Becky Quick will promptly provide the person who provided the original DMCA notification with a copy of the Counter-Notification and inform that person that Becky Quick will replace the removed material or cease disabling access to it in 10 business days. Becky Quick will replace the removed material and cease disabling access to it in 10 to 14 business days after receipt of the Counter-Notification, unless Becky Quick's Designated Copyright Agent first receives notice from the person who submitted the original DMCA notification that such person has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on Becky Quick's system.
